d2design EVENT MAIL™ Terms and Conditions

Disclaimer of Warranties and Liability & Service Description
Event Mail™ is intended to provide your church with the ability to saturate zip codes or carrier routes with your direct mail postcard for the purposes of event promotion. We cannot guarantee that all names provided by our service are the names and contact information of current residents. We have intentionally partnered with the list service provider we believe provides the most accurate and reliable information available to the public. This partner uses multiple sources to identify current residents including credit card updates, public records, magazine subscription address changes, and new phone hook-ups. Nevertheless, due to various factors including the inherent possibility of human and mechanical error, the accuracy, completeness, timeliness, results obtained from its use, or correct sequencing is not guaranteed by d2design or any person representing d2design.

ORDER APPROVAL
Customer is fully responsible for final proof approval (pdf proof only) prior to the printing process. Proofs reflect design layout, text accuracy, and image proportion and placement. d2design is not liable for color matching on proofs approved by customers. d2design is NOT LIABLE for errors in a final product including but not limited to: misspellings, grammar, and punctuation, as well as incorrect phone numbers, addresses, and maps.

UNITED STATES POST OFFICE
Unless otherwise stated, d2design assumes that your church has non-profit status with the United States Post Office. Should your status be revoked or you do not qualify for non-profit status with the USPS, you will be billed at the actual postage amount you qualify for. d2design only guarantees timely delivery of the mailing to the US Post Office or SCF facility. d2design assumes no responsibility for the timely delivery of mail from the US Post Office..

POSTAGE
Postage rates are beyond d2design’s control. d2design pre-pays postage as a service to the customer. Postage is 100% the customer’s responsibility; no exceptions are made. In signing this agreement, the customer agrees to these terms and furthermore authorizes d2design to use the customer credit card on file to pay the full postage balance.

PAYMENT
d2design requires payment in full before shipping or mailing your job (d2design accepts checks and ACH only for direct mail). In the event d2design completes your order without payment in full, you will be subject to the following terms: Balances past 30 days are subject to 1% interest rate per month until paid in full. In the event of default by purchaser, purchaser shall pay for expenses of seller in enforcement of remedies including reasonable attorney’s fees and legal expenses.

CANCELLATIONS
If you cancel an order before we begin the design process, no cancellation fee will be assessed. If you cancel after we begin design, you will be billed for design services in the amount of $250. If cancellation is received after design approval, the sale is final and no refunds can be issued.

RETURNS & REFUNDS
Since each order is unique to a customer and has no re-sale value, all sales are final.

ConnectFirst is intended to provide your church with the information you need to connect with new movers. We cannot guarantee that all names provided by ConnectFirst services are the names and contact information of new movers only. We have intentionally partnered with the list service provider we believe provides the most accurate and reliable information available to the public. This partner uses multiple sources to identify new movers including credit card updates, public records (new homeowner deed filings), magazine subscription address changes, and new phone hook-ups. Nevertheless, due to various factors including the inherent possibility of human and mechanical error, the accuracy, completeness, timeliness, results obtained from its use, or correct sequencing is not guaranteed by d2design or any person representing d2design.

Service Period
The service period begins on the 1st day of each month, and all ConnectFirst cards are mailed by the Friday of the 2nd full week of the month.

New Mover Data
We identify the new movers within 3 to 12 weeks of their move. Most records we compile are between 30 and 90 days of the move. A document containing the names and addresses of the recipients is e-mailed by the Wednesday of the 3rd full week of the month.

Termination & Cancellation
d2design reserves the right to modify or terminate this service at any time. Any modification, revision, or update of this Agreement shall be effective upon notice to the customer. This Agreement is effective until terminated by either party. You may terminate this agreement at any time. Cancellation is effective as of the end of the service period of the month in which you terminate your subscription. Cancellations received after the 15th of the month are considered for the following month. You are responsible for paying and will be billed for the entire monthly fee for all services you were subscribed to at the time of cancellation.

Credit & Billing
A valid credit card is needed to set up the account and will be immediately used upon confirmation of the order to collect the non-refundable set-up fee. Invoices are dated the 15th day of the month of the service period with 10-day terms. If at any time, terms exceed 45 days, the credit card on record will be used to bring the account within terms.

Proof Approval
Two rounds of proofs are included in your fee. Additional changes will occur additional fees.

Design Changes
Setting up a new template incurs a $150 setup fee ($80 for additional sequence).


This Agreement is governed by the laws of the state of Alabama without regard to its provisions of conflicts of law. By agreeing, you testify that you are authorized to make this decision for your church and that you and the church are jointly and separately responsible for abiding by these terms and conditions.
